MARCA
Na franquia é cedido o direito de uso da marca
para os franqueados. Para que o franqueador
possa fazer isto precisa que a marca seja

Além das questões formais de registro a marca
precisa ser reconhecida positivamente pelo
mercado. Deve ser realizado um trabalho
contínuo de promoção e proteção da marca.

MERCADO
Existem dois aspectos que devem ser observados: o
tamanho e a tendência. O mercado deve ser grande e ter
uma tendência de crescimento. Franquear um negócio
que é apenas "moda" ou está num mercado em declínio
não é correto. Vai prejudicar os franqueados.
O mercado deve ser suficientemente grande para que
possam existir  muitas unidades franqueadas e todas
tenham para quem vender.

KNOW-HOW
É o "saber como fazer", isto envolve a gestão, a
operação e comercialização dos
produtos/serviços da franquia.

O franqueador precisa dominar todo o
conhecimento necessário para o sucesso de
uma operação da marca. Em especial o "como
vender"!

Na definição do modelo de franquia deve ser
identificado se todo o know-how será
transferido, ou somente uma parte. Por
exemplo uma indústria de cosméticos não
transfere aos franqueados o conhecimento
sobre como produzir  sabonetes ou
shampoos. Transfere apenas a parte  do seu
know-how que é aquela relacionada ao
varejo.
